agree to be bound by the terms and conditions of the Agreement as long as you

selection of rejection made by the registered members of opposite gender. You
could not to register for particular person we will give as more service.
TERMS OF USE
In order to use the ORGANIZATION Site (“Site”), you must register as a member
of the Site (“Member”). The Member or any users using the Site agree
to be bound by these Terms of Use (“Agreement”). If you wish to become a Member
and promote/ advertise your profile to other Members and make use of the
ORGANIZATION service (“Service”), read these Terms of Use and follow the
instructions in the Registration process. The Service shall inter-alia assist

BY THE POSITIVE ACTS OF A USER ACCESSING THE www.gaurimarriages.com, THE USER
AGREES TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW (“Terms”). IF A
USER DOES NOT AGREE WITH ANY OF THESE TERMS AND CONDITIONS, HE/SHE SHOULD NOT

Marriage Bureau, (hereinafter referred to as ”Organization”), which term shall,
for the purposes hereof, be deemed to include its subsidiaries, affiliates,
partners, directors, executives, officers, employees, agents, attorneys,
accountants and any person vested with any responsibility for any task relating
to the affairs of the Organization).
To register as a member of ORGANIZATION or use this Site, you must be of legal
marriageable age as per the laws of India (currently, 18 years or over for
females and 21 years or over for males). The ORGANIZATION site is only to
facilitate personal advertisement for lawful marriage alliance between persons
who are legally competent to enter into matrimony under the laws to which they
are subject. Membership in the Service is void where prohibited. By using this
Site, you represent and warrant that you have the right, authority, and legal
capacity to enter into this Agreement and that you are not prohibited or
prevented by any applicable law for the time being in force or any order or
decree or injunction from any court, tribunal or any such competent authority
restraining you from entering into matrimony. You also agree to abide by all of
the terms and conditions of this Agreement. If at any time ORGANIZATION is of
the opinion (in its sole discretion) or has any reason to believe that you are
not eligible to become a member or that you have made any misrepresentation
about your eligibility, ORGANIZATION reserves the right to forthwith terminate
your membership and / or your right to use the Service without any refund to
you of any of your unutilized subscription fee.
The www.gaurimarriages.comis intended only to serve as a preliminary medium of
contact and information for Users who have a bona fide intention to enter into
a matrimonial alliance (“Purpose”).
The organization presumes that every User who logs on to www.gaurimarriages.com/register
with the organization has a bona fide intention to get married / enter into a
matrimonial alliance and not otherwise. Organization under no circumstances
shall be responsible for any loss or damage resulting from anyone's use of the www.gaurimarriages.comor
the services offered on www.gaurimarriages.comand / or any content posted on
the www.gaurimarriages.comor transmitted to Users. The exchange of matrimonial
profile(s) through or by the www.gaurimarriages.comshould not in any way be
construed as a matrimonial offer and/or recommendation from or by the
organization. Organization shall not be responsible for any loss or damage to
any individual arising in/out of, or subsequent to, matrimonial relations
established pursuant to use of the service provided by organization.
In order to use www.gaurimarriages.com, the registered users/subscriber and
unregistered user agreed that the organization may collects information/data
including, without limitation, e-mail id, address, first name, last name,
telephone/mobile number, date of birth, age, gender, ethnic/cultural
background, appearance/photo, religion, occupation, preferences, life style
information, general geographical location (“User Data”) from Users in order to
enable them to create their profiles on the www.gaurimarriages.com. Apart from
this, certain other health related information, including physical and mental
disabilities are also collected. The User Data so collected is entered in a
program especially devised for matching profiles and to provide matches for
Users based on their pre-selected partner preferences criteria. The registered
users /subscriber and unregistered user agreed that there data can be as they
given their consent by agreeing the instant terms and condition. Organization
does not collect financial information of registered users /subscriber such as
credit card/debit card numbers/bank accounts numbers etc
Users undertake not to duplicate, download publish, modify and distribute
material on the shreesamarthmarriagebureau.com unless specifically authorized
by the organization in writing. Users undertake not to establish any deep link
or other connection to any specific page of the www.gaurimarriages.comwithout
obtaining prior written consent of the organization.
Users undertake to use the shreesamarthmarriagebureau.com for their personal

works with a commercial motive without prior written consent from the
organization is strictly prohibited.
Any advice, counselling, recommendations or information provided on the

endorse matches and profiles in any manner, but an implied presumption is cast
on the Users that the information(s) furnished are exclusively / solely to
carve out / frame a suitable profile for the purpose of matrimonial alliance
based on the partner preferences criteria set by the Users. All due diligence,
effort and initiatives must be exercised by those wishing to use any
information found on the www.gaurimarriages.com, and should take adequate
precautions with the full and complete knowledge that all information contained
in the matrimonial listings have been placed there directly by Users of the www.gaurimarriages.comwithout
any prior intimation, consent or verification of or by Organization.

posting, transmitting, updating or sharing any information that:
belongs to another person and to which the user does not have any right to;
is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic,
podophilic, libellous, invasive of another's privacy, hateful, or racially,
ethnically objectionable, disparaging, relating or encouraging money laundering
or gambling, or otherwise unlawful in any manner whatever; harm minors in any
way;

entitled to a refund of any unutilized subscription fees, if any, paid by
his/her, except where otherwise stated in writing. ORGANIZATION may terminate
User access to the Site and/or their membership for any reason effective upon
sending notice to User at the email address as provided by User in application
for membership or such other email address as User may later provided to
ORGANIZATION. If ORGANIZATION terminates User membership for breach of terms of
this Agreement, User will not be entitled to any refund of any unused
Subscription fees, if any, paid by User. Term for the paid Membership would be
in accordance with the type of membership undertaken
Organization is an online service provider for Users to create their own/unique
profiles envisaging certain personal (optional) information(s) and User Data
are to be displayed on the www.gaurimarriages.com, which information is used by
Users for the Purpose. Organization does not share User Data with other Users
or third parties with the prior consent of the User. Although Organization
shall take all reasonable precautions, Organization shall not be responsible in
case such User Data so displayed on the www.gaurimarriages.combeing
unauthorized copied / printed / published / forged / superimposed / manipulated
etc. or misused by any User. Users shall indemnify Organization from all kind
of losses / damages which Organization may suffer from any activities carried

By listing a matrimonial profile, or a business or personal listing or a link,
or any content or listing, on the www.gaurimarriages.com, the concerned User
making or posting such listing, and the person or persons responsible for such
posting or listing, shall be deemed to have agreed to hold Organization
harmless and protected against any suit or complaint, civil, pecuniary or
criminal, and against any claims or damages (including, without limitation,
interests, fines and penalties) which may be brought against or levied on
Organization on account of any matter arising out of, or relating to, such
posting / listing or response received from such posting/listing.
Whilst using the www.gaurimarriages.coman obligation is cast upon Users to only
provide true and correct information and in the case of creating a profile
Users undertake at all times to keep the information up to date. Organization
does not represent or endorse the accuracy or reliability of any member /
visitor profile, advice, opinion, statement or other information displayed /

owners, staff or agents are not responsible under any circumstances for any
action/display whether direct or indirect, which occurs as a result of online

community or any material which may promote racism, bigotry, hatred or physical/mental
harm of any kind to any group or individual or transmit any chain letters or

Organization reserves the right to remove / delete any content / message /
photo(s) / profile or cancel the registration / membership of a User either
upon a complaint received from another User or upon discovery of the same on
its own or based on its sole judgment and perception and it shall without
notice stop providing the service entitled to a User and forfeit all other
incidental service(s) with immediate effect along with the fee/tenure of
registration as well as take appropriate legal action against such User. By
listing a profile on the shreesamarthmarriagebureau.com , it is deemed that the
said User has an intention to get married and in case it appears to
Organization that at the time of listing the profile or subsequently such User
had no intention to enter into a matrimonial alliance or has changed his/her
intention, then Organization shall reserve the right to remove / delete such profile
from the www.gaurimarriages.comand initiate prosecution under the law or take
such steps as may be advised from time to time. By using the www.gaurimarriages.com,
it is deemed that the User agrees not to post any content or views that may be
considered threatening, abusive, vulgar, obscene or otherwise objectionable or
act illegally or otherwise harass another user; put wrong or misleading
information in any of the details of his/her own profile; impersonate another
or use the site for any commercial purposes; or interfere with or disrupt the
operation of this site, or disobey any reasonable requirements, procedures or
policies imposed by Organization from time to time.
Organization shall not be held responsible for any interactions/ passing of
information(s) etc. between any User via e-mail, chat or any other medium with
another User and Organization has no obligation, to monitor any such disputes
arising between the Users and Organization shall not be party to such dispute/litigation
etc.
Organization reserves the absolute right to modify or amend or delete, in any
manner as it deems fit, any content of any matrimonial listing placed on the
shreesamarthmarriagebureau.com in order to ensure compliance with the rules of
such placement (which may include, without limitation, the efforts and
initiatives by Organization to maximize response to matrimonial listings),
prima facie accuracy and the prevailing laws in force for the time being,
especially those relating to prohibition of any indecent, unlawful or obscene
content. Organization reserves the absolute right to delete any profile if it
finds that the same person has created multiple profiles on the www.gaurimarriages.com.
Even if different profiles have been created with the same contact details,
Organization will reserve the absolute right to delete all such profiles. If
any member refuses to give consent to a physical address verification that
Organization has requested then Organization will have the absolute right to
either put a "Not Verified" stamp on the profile or to delete the
profile.

and Organization does not, in any manner whatsoever, recommend, authenticate,

for damages, restitution, loss-of-profits, or any other pecuniary, civil or

refundable and any amount paid shall stand appropriated. Refund if any will be

card/bank accounts. Organization gives no guarantees of server uptime or

Organization also reserves the right to investigate and take appropriate legal
action without limitation at its sole discretion against any User who violates

such violators without prior intimation who utilise the www.gaurimarriages.comin
any manner which brings into disrepute or impairs the interests and functioning

Organization does not take the responsibility of any information posted by its
Users on the www.gaurimarriages.com, any copyrighted material, trademarks, or
other proprietary information without obtaining the prior written consent of
the owner of such proprietary rights and in case Organization
receives/discovers any such infringement, the said User may be called for /
asked to furnish / provide evidence / relevant information in support of such
display like an electronic or physical signature of the person authorized to
act on behalf of the owner of the copyright interest or a description of the
copyrighted work that may have been infringed or information or a written
statement that the User under bona-fide faith belief that the disputed
information does not lead to any authorized use or infringement of copyright

declaration that the information displayed/posted is accurate and the User is
itself the copyright owner or authorized to act on the copyright owner's

Organization has no obligation to monitor the activities of its Users. However,
Organization has the right to monitor the www.gaurimarriages.comelectronically
from time to time and to disclose any information as necessary to satisfy any
law, regulation or other governmental request, to operate the www.gaurimarriages.comproperly,
or to protect itself or its Users. Organization also reserves the right to
refuse to post or to remove any information or materials, in whole or in part,
that, in its sole discretion, are unacceptable, undesirable, or violative of
provision of law.
In case Organization receives any incriminating evidence/complaint against any
User from other Users of the www.gaurimarriages.comor if Organization, through
data available to it from its servers, suspects misbehaviour on any User’s
part, it reserves the right to impose restrictions on the User’s account which
include but may not be confined to preventing the User under question from
making multiple contacts and restricting the user to only contact members whose
desired partner profile the User satisfies.
Users of the shreesamarthmarriagebureau.com are consenting for receiving
Membership Emails: Emails conveying the benefits of paid membership to Users.
These are sent to the Email address mentioned by the Users in their profile.
Users consenting to Email communication for any kind of legal issue.
c) Important Notifications from the shreesamarthmarriagebureau.com–
Messages/notifications are sent to Users to inform them of various alerts
related to usage of the www.gaurimarriages.com. . These will be communicated to
the Users by Email/app notifications etc. or on their Landline/Mobile via
SMS/MMS/VMS/USSD/IVR/Calls etc.
d) Membership SMS/Calls: SMS or phone calls shall be sent conveying the
benefits of paid membership to Users. Users will receive these calls or SMS on
any of the phone numbers mentioned by Users on their profile, if they have
subscribed to calls/ SMS in their alert manager settings.
Any profile deleted by the profile user cannot be retrieved under any circumstances.
Unless otherwise specified and notwithstanding anything contained in any other
agreement or arrangement, by whatever name called, the performance obligation
of Organization (service provider) is to provide access of its on-line portal
to the customer for the duration of the subscription period & reference to
any usage, by whatever name called or any other performance obligation, if any,
is to provide the upper limit for consumption, which by itself, does not create
any additional performance obligation upon Organization.
RESTRICTION / PROHIBITIONS
The following actions will inter alia constitute a misuse of the www.gaurimarriages.comand
are strictly prohibited:
Copying, extracting, downloading, sharing, modifying, selling, storing,
distributing, making derivate works from or otherwise exploiting any content,
data, information, including profiles, curriculum vitae, photographs and/or

or products of the Organization, in any manner or for any purpose which is not,
consistent with the Purpose and/or in accordance with the Terms of Use. Users

in any manner, any data or content including but not limited to adding or
downloading profiles, contact details, or send or redirect messages from the www.gaurimarriages.com.
Gaining or attempting to gain unauthorized access (inter alia by hacking,
password “mining” or any other means) to:

attempting to probe, scan or test the vulnerability of the Organization’s

the Organization;

attempting to do any of the aforesaid or deriving the source code for the Site
or Application or any related technology or any part thereof;
PROPRIETARY RIGHTS IN THE CONTENT ON ORGANIZATION
ORGANIZATION owns and retains all proprietary right in the ORGANIZATION site
and the ORGANIZATION service. The site contains the copyrighted material,
trademarks, and other proprietary information of ORGANIZATION and its licensor.
Except for that information which is in the public domain such as member
profile or for which permission has been obtained from the user, you cannot
copy, modify, and publish. Transmit, distribute, perform, display, or sell any
such proprietary information. Any such act or an attempted act on Users part
shall constitute a volition of this agreement and Users membership is liable to
be terminated forthwith by ORGANIZATION without refund of any of Users unused
subscription fees. We also reserve our rights to take legal action (Civil and/
or criminal) wherever applicable for any violation.
MEMBERS DISPUTES
Users are solely responsible for advertisement/communications with other
ORGANIZATION Members. ORGANIZATION reserves the right, but has no obligation,
to monitor disputes between Users. ORGANIZATION also reserves the right to take
appropriate action against errant members. However, ORGANIZATION is not obliged
to share such action with other members, including complainants. ORGANIZATION
expressly disclaims any responsibility or liability for any transactions or
interactions between the members inter-se.
JURISDICTION
If there is any dispute about or involving the Site and/or the Service, by
using the Site, Users unconditionally agree that all such disputes and/or
differences will be governed by the laws of India and shall be subject to the
exclusive jurisdiction of the Competent Courts in Nagpur, Maharashtra only.
INDEMNITY
Users agree to indemnify and hold ORGANIZATION, its subsidiaries,
affiliates, officers, agents, and other partners and employees, fully
indemnified and harmless from any loss, liability, claim, or demand, including
reasonable attorney’s fees, made by any third party due to or arising out of
your use of the Service in violation of this Agreement and/or arising from a
breach of these Terms of Use and/or any breach of Users representations and
warranties set forth above and/or any fraudulent act on Users part.
OTHER
This Agreement, accepted upon use of the Site and further affirmed by becoming
a Member of the ORGANIZATION service, contains the entire agreement between
Users and ORGANIZATION regarding the use of the Site and/or the Service. If any
provision of this Agreement is held invalid, the remainder of this Agreement
shall continue in full force and effect. That by becoming a member/ Users of
ORGANIZATION and/or using the Services of the Site, Users unconditionally and
irrevocably confirm that they have read and understood the above provisions and
agree to abide by them.
SOLEMN AFFIRMATION
I, the subscriber/ Users do hereby take oath and state on solemn affirmation
that the contents of the above terms and condition and all the paragraphs are
true and correct to the best of my personal knowledge and belief and the same
is binding on me unconditionally and irrevocably and I agree to abide by them as
per law.
