to be bound by these Terms of Use (“Agreement”). The Gaurimarriages.com (Platform) is owned and operated by GAURI MARRIAGES, (hereinafter referred to as ”Organization”), which term shall, for the purposes hereof, be deemed to include its subsidiaries, affiliates, partners, directors, executives, officers, employees, agents, attorneys, accountants and any person vested with any responsibility for any task relating to the affairs of the Organization).

To register as a member of ORGANIZATION or use this Site, you must be of legal marriageable age as per the laws of India (currently, 18 years or over for females and 21 years or over for males). The ORGANIZATION site is only to facilitate personal advertisement for lawful marriage alliance between persons who are legally competent to enter into matrimony under the laws to which they are subject. Membership in the Service is void where prohibited. By using this Site, you represent and warrant that you have the right, authority, and legal capacity to enter into this Agreement and that you are not prohibited or prevented by any applicable law for the time being in force or any order or decree or injunction from any court, tribunal or any such competent authority restraining you from entering into matrimony. You also agree to abide by all of the terms and conditions of this Agreement. If at any time ORGANIZATION is of the opinion (in its sole discretion) or has any reason to believe that you are not eligible to become a member or that you have made any misrepresentation about your eligibility, ORGANIZATION reserves the right to forthwith terminate your membership and / or your right to use the Service without any refund to you of any of your unutilized subscription fee.

The www.gaurimarriages.com is intended only to serve as a preliminary medium of contact and information for Users who have a bona fide intention to enter into a matrimonial alliance (“Purpose”).

The organization presumes that every User who logs on to www.gaurimarriages.com/register with the organization has a bona fide intention to get married / enter into a matrimonial alliance and not otherwise. Users undertake not to duplicate, download publish, modify and distribute material on the Gaurimarriages.com unless specifically authorized by the organization in writing. Users undertake not to establish any deep link or other connection to any specific page of the www.gaurimarriages.com without obtaining prior written consent of the organization.

ORGANIZATION may terminate User access to the Site and/or their membership for any reason effective upon sending notice to User at the email address as provided by User in application for membership or such other email address as User may later provided to ORGANIZATION. If ORGANIZATION terminates User membership for breach of terms of this Agreement, User will not be entitled to any refund of any unused Subscription fees, if any, paid by User. Term for the paid Membership would be in accordance with the type of membership undertaken

Organization is an online service provider for Users to create their own/unique profiles envisaging certain personal (optional) information(s) and User Data are to be displayed on the www.gaurimarriages.com, which information is used by Users for the Purpose. Organization does not share User Data with other Users or third parties with the prior consent of the User. Although Organization shall take all reasonable precautions, Organization shall not be responsible in case such User Data so displayed on the www.gaurimarriages.com being unauthorized copied / printed / published / forged / superimposed / manipulated etc. or misused by any User. Users shall indemnify Organization from all kind of losses / damages which Organization may suffer from any activities carried out by them through improper use of the www.gaurimarriages.com/service provided by Organization.

Organization reserves the right to remove / delete any content / message / photo(s) / profile or cancel the registration / membership of a User either upon a complaint received from another User or upon discovery of the same on its own or based on its sole judgment and perception and it shall without notice stop providing the service entitled to a User and forfeit all other incidental service(s) with immediate effect along with the fee/tenure of registration as well as take appropriate legal action against such User. By listing a profile on the Gaurimarriages.com, it is deemed that the said User has an intention to get married and in case it appears to Organization that at the time of listing the profile or subsequently such User had no intention to enter into a matrimonial alliance or has changed his/her intention, then Organization shall reserve the right to remove / delete such profile from the www.gaurimarriages.comand initiate prosecution under the law or take such steps as may be advised from time to time. By using the www.gaurimarriages.com, it is deemed that the User agrees not to post any content or views that may be considered threatening, abusive, vulgar, obscene or otherwise objectionable or act illegally or otherwise harass another user; put wrong or misleading information in any of the details of his/her own profile; impersonate another or use the site for any commercial purposes; or interfere with or disrupt the operation of this site, or disobey any reasonable requirements, procedures or policies imposed by Organization from time to time.

Organization shall not be held responsible for any interactions/ passing of information(s) etc. between any User via e-mail, chat or any other medium with another User and Organization has no obligation, to monitor any such disputes arising between the Users and Organization shall not be party to such dispute/litigation etc.

Organization reserves the absolute right to modify or amend or delete, in any manner as it deems fit, any content of any matrimonial listing placed on the Gaurimarriages.com in order to ensure compliance with the rules of such placement (which may include, without limitation, the efforts and initiatives by Organization to maximize response to matrimonial listings), prima facie accuracy and the prevailing laws in force for the time being, especially those relating to prohibition of any indecent, unlawful or obscene content. Organization reserves the absolute right to delete any profile if it finds that the same person has created multiple profiles on the www.gaurimarriages.com. Even if different profiles have been created with the same contact details, Organization will reserve the absolute right to delete all such profiles. If any member refuses to give consent to a physical address verification that Organization has requested then Organization will have the absolute right to either put a "Not Verified" stamp on the profile or to delete the profile.

Organization has no obligation to monitor the activities of its Users. Membership Emails: Emails conveying the benefits of paid membership to Users. These are sent to the Email address mentioned by the Users in their profile.

Users consenting to Email communication for any kind of legal issue.

c) Important Notifications from the Gaurimarriages.com– Messages/notifications are sent to Users to inform them of various alerts related to usage of the www.gaurimarriages.com. . These will be communicated to the Users by Email/app notifications etc. or on their Landline/Mobile via SMS/MMS/VMS/USSD/IVR/Calls etc.

d) Membership SMS/Calls: SMS or phone calls shall be sent conveying the benefits of paid membership to Users. Users will receive these calls or SMS on any of the phone numbers mentioned by Users on their profile, if they have subscribed to calls/ SMS in their alert manager settings.

Any profile deleted by the profile user cannot be retrieved under any circumstances.

Unless otherwise specified and notwithstanding anything contained in any other agreement or arrangement, by whatever name called, the performance obligation of Organization (service provider) is to provide access of its on-line portal to the customer for the duration of the subscription period & reference to any usage, by whatever name called or any other performance obligation, if any, is to provide the upper limit for consumption, which by itself, does not create any additional performance obligation upon Organization.

RESTRICTION / PROHIBITIONS

The following actions will inter alia constitute a misuse of the www.gaurimarriages.com and are strictly prohibited:

Copying, extracting, downloading, sharing, modifying, selling, storing, distributing, making derivate works from or otherwise exploiting any content, data, information, including profiles, curriculum vitae, photographs and/or graphics, available on the Gaurimarriages.com and/or any services or products of the Organization, in any manner or for any purpose which is not, consistent with the Purpose and/or in accordance with the Terms of Use. Reselling the products/services offered by the Organization.

(Using or attempting to use any automated program, software or system or any similar or equivalent process (including spiders, robots, crawlers etc.) to access, navigate, search, copy, monitor, download, scrape, crawl or otherwise extract in any manner, any data or content including but not limited to adding or downloading profiles, contact details, or send or redirect messages from the www.gaurimarriages.com.

Gaining or attempting to gain unauthorized access (inter alia by hacking, password “mining” or any other means) to:

any portion or feature of the Gaurimarriages.com or any of the services or products offered on or through the www.gaurimarriages.com which are not intended for you;

any server, website, program or computer systems of the Organization or any other third parties and/or Users;

Except for that information which is in the public domain such as member profile or for which permission has been obtained from the user, you cannot copy, modify, and publish. Any such act or an attempted act on Users part shall constitute a volition of this agreement and Users membership is liable to be terminated forthwith by ORGANIZATION without refund of any of Users unused subscription fees. We also reserve our rights to take legal action (Civil and/ or criminal) wherever applicable for any violation.

MEMBERS DISPUTES

Users are solely responsible for advertisement/communications with other ORGANIZATION Members. ORGANIZATION reserves the right, but has no obligation, to monitor disputes between Users. ORGANIZATION also reserves the right to take appropriate action against errant members. However, ORGANIZATION is not obliged to share such action with other members, including complainants. ORGANIZATION expressly disclaims any responsibility or liability for any transactions or interactions between the members inter-se.

JURISDICTION

If there is any dispute about or involving the Site and/or the Service, by using the Site, Users unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in Nagpur, Maharashtra only.

INDEMNITY

Users agree to indemnify and hold ORGANIZATION, its subsidiaries, affiliates, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of Users representations and warranties set forth above and/or any fraudulent act on Users part.

OTHER

This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the ORGANIZATION service, contains the entire agreement between Users and ORGANIZATION regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. That by becoming a member/ Users of ORGANIZATION and/or using the Services of the Site, Users unconditionally and irrevocably confirm that they have read and understood the above provisions and agree to abide by them.

SOLEMN AFFIRMATION

I, the subscriber/ Users do hereby take oath and state on solemn affirmation that the contents of the above terms and condition and all the paragraphs are true and correct to the best of my personal knowledge and belief and the same is binding on me unconditionally and irrevocably and I agree to abide by them as per law.
